At Mulliken Weiner Berg & Jolivet P.C., we’ve recognized the growth and need for mediation and arbitration in a society where a lawsuit may be too slow, too expensive or simply unnecessary. With trained mediators and arbitrators at our firm, we are pleased to be able to offer attorneys and individual parties faster, more informal and less expensive dispute resolution procedures than that provided by litigation in the state and federal courts. The courts have also recognized this same issue, ordering parties to arbitrate, mediate, or conduct other forms of alternative dispute resolution (ADR), sometimes even before the discovery process begins or pursuant to an agreement between the parties.
Our lawyers serve as mediators and arbitrators for other parties, both privately and in court-ordered ADR. We have experience in both mediation and arbitration throughout Colorado as well as representing our clients in forums across the United States.
Our attorneys arbitrate cases under the rules of leading arbitration organizations including the American Arbitration Association (AAA), International Centre for Dispute Resolution (ICDR), the Center for Public Resources (CPR) and the International Chamber of Commerce (ICC), as well as before ad hoc arbitration tribunals operating under the UNCITRAL and other Rules. We also have extensive experience in proceedings under the Federal Arbitration Act and the New York Convention. Our practice includes the representation of individuals, organizations and businesses in disputes including commercial contracts, infrastructure projects, construction projects, investment disputes, mergers and acquisitions, real estate, land use and employment matters.
In addition, our lawyers advise in the drafting, interpretation and enforcement of arbitration clauses as well as litigation related to the arbitration process, such as motions to compel arbitration, challenges to the makeup of the arbitral panel and post-arbitration enforcement of awards. For mediation, we provide both counseling in the mediation process as well as offering our services as third party mediators, attempting to guide or resolve disputes without recourse to additional litigation or arbitration proceedings.
Mulliken Weiner Berg & Jolivet P.C. can offer attorneys and parties intelligent, competent and legally knowledgeable mediators and arbitrators throughout the state of Colorado in JAMS, AAA and other arbitration and mediation protocols. Our offices are located in downtown Colorado Springs, Colorado, close to the El Paso County Courthouse and easily accessible by Mountain Metro Transit and private transportation.
