At Mulliken Weiner Berg & Jolivet P.C., we have a long history of successful experience representing our clients in appeals before the Colorado Court of Appeals and the Colorado Supreme Court. With a client-focused strategy and determination to succeed, our attorneys are known for their desire to achieve the best possible results for each client.  After graduating law school, Murray Weiner clerked at both the United States District Court for the District of Colorado and the United States Circuit Court for the Tenth Judicial Circuit (Denver).  Mr. Weiner has handled numerous appeals at the Tenth Circuit Court of Appeals from the Bankruptcy Court and the Federal District Court in Denver and the Bankruptcy Appellate level.

Colorado’s appellate system

Colorado, like many of our sister states, has a two-tier appellate system for hearing arguments regarding mistakes made by a lower-level court, tribunal or agency in law or fact. Typically, an appeal proceeds to the Colorado Court of Appeals from the district court and any special courts (such as those that are found in Denver). In addition, in our administrative practice, we often are able to appeal directly from the administrative agency to the Court of Appeals. In either case, the decision of the Court of Appeals is final unless the Colorado Supreme Court agrees to hear the case. In rare cases, the Colorado Supreme Court will hear an appeal directly from the trial court.

Although it is often necessary, the appellate process often takes significant amounts of time and money. As we generally represent our long-term clients in appeals, we recognize the pitfalls with the appellate process, including the situations that may be encountered, the standard of review the higher-level court will use and what we believe will be the winning argument — as well as the chance of success. We also will consider if there are any chances of settlement or other, more desirable outcomes. In any event, if a client believes that an appeal is the best choice, the attorneys at Mulliken Weiner Berg & Jolivet P.C. move quickly and effectively to protect our clients’ interests in every matter.
