After an extremely difficult 2+ year project at Fort Lewis College in Durango, Colorado, on a new science building, a mechanical contractor pursued a lost labor productivity claim against the general contractor, Jaynes Corporation of Colorado. The mechanical contractor claimed Jaynes’ failure to properly schedule, coordinate and manage the project caused it significant damages. In response, Jaynes claimed the subcontractor had caused Jaynes damages. After a highly contested two-week arbitration the mechanical contractor’s claim Jaynes had breached the Subcontract was vindicated when the arbitration panel awarded it over $600,000 with interest, attorney’s fees and costs, making the total award over $1,000,000. Jaynes’ retaliatory counterclaim was denied in its entirety.
