Contractor Gets $565K 'Time Out' Following Jury Trial in Dispute Over Design of Childcare Center 11/10/2009

On November 10, 2009, after a four day jury trial, the jury returned a verdict in favor of McCoy & Littlejohn Child Care Center, LLC and against Aspen Diversified Industries Services, Inc. in the amount of $565,000 on claims of breach of contract, breach of fiduciary duty, and negligent misrepresentation.  Greg O’Boyle represented the plaintiff McCoy & Littlejohn Child Care Center, LLC at trial.

 

The case arose out of Aspen Diversified’s failure to design a childcare center for McCoy & Littlejohn that would accommodate the 100 children required in order for the childcare center to be profitable.  McCoy & Littlejohn was awarded the entire amount it sought against Aspen Diversified.
